כללי

אפליקציית Near u ("האפליקציה") מופעלת על ידי בועז גולן ניהול והפקות בע"מ, ח"פ 516772696 ("אנחנו"). השימוש באפליקציה מהווה הסכמה לתנאים אלה ולמדיניות הפרטיות. אם אינכם מסכימים, אל תשתמשו באפליקציה.

הרשמה וגיל

• השימוש מותר מגיל 18 ומעלה בלבד.
• ההרשמה נעשית עם מספר טלפון שבשימושכם וקוד חד-פעמי ב-SMS. יש למסור פרטים נכונים ולשמור על המכשיר והחשבון.
• אפשר לצפות במפה כאורח בלי הרשמה. שליחת הודעות, שיחות והוספת חברים דורשות הרשמה.

מיקום

האפליקציה מבוססת על מיקום ולא ניתן להשתמש בה בלי גישה למיקום. משתמשים בקרבתכם יראו אתכם על המפה, כולל המיקום והמרחק, אלא אם הפעלתם מצב בלתי נראה או הסתרתם את עצמכם מהם. שתפו מיקום רק אם זה מתאים לכם.

התנהגות אסורה

אסור להשתמש באפליקציה כדי:

• להטריד, לאיים, להשמיץ, לעקוב אחרי אדם או לפגוע בו;
• לשלוח תוכן מיני בוטה, אלים, גזעני, שמסית לשנאה או שאינו חוקי;
• להתחזות לאדם אחר או למסור פרטים כוזבים;
• לשלוח ספאם, פרסומות או הונאות;
• לשלוח תוכן שאין לכם זכות לשתף, או תמונות של אנשים בלי הסכמתם;
• לפגוע באפליקציה, לעקוף מגבלות או לאסוף מידע על משתמשים בדרכים אוטומטיות.

אפשר להסתיר את עצמכם מכל משתמש, ואז הוא לא יראה אתכם ולא יוכל לשלוח לכם הודעות. לדיווח על משתמש או תוכן פנו אלינו בכתובת nearu@nearu.co.il.

התוכן שלכם

התוכן שאתם מעלים (פרופיל, תמונות, הודעות, הודעות קוליות וסרטונים) נשאר שלכם. אתם מעניקים לנו רשות מוגבלת לאחסן, לעבד (למשל להמיר פורמט) ולהעביר אותו, רק לצורך הפעלת האפליקציה. אתם אחראים לתוכן שאתם שולחים.

משתמשי דמו

כדי להמחיש איך האפליקציה עובדת, היא עשויה להציג סביבכם פרופילים לדוגמה שמסומנים "דמו". אלה אינם אנשים אמיתיים, והם עונים להודעות באופן אוטומטי. אפשר לכבות אותם בהגדרות ("משתמשי דמו").

בטיחות

אנחנו לא בודקים את זהות המשתמשים או את הרקע שלהם. היו זהירים במפגש עם אנשים שהכרתם באפליקציה: היפגשו במקום ציבורי, ספרו לחבר לאן אתם הולכים, ואל תמסרו מידע רגיש. האחריות למפגשים ולקשרים עם משתמשים אחרים היא שלכם.

השעיה וסגירת חשבון

אנחנו רשאים להגביל, להשעות או למחוק חשבון שמפר את התנאים. אתם יכולים למחוק את החשבון בכל עת באפליקציה (פרופיל, ואז "מחיקת החשבון").

זמינות ואחריות

האפליקציה ניתנת "כמות שהיא" (AS IS). איננו מתחייבים שתפעל תמיד, בלי תקלות או בלי הפסקות, או שהמיקום והמרחקים יהיו מדויקים. ככל שהחוק מתיר, לא נהיה אחראים לנזק עקיף או תוצאתי, או לנזק שנגרם מהתנהגות של משתמשים אחרים.

שינויים

אנחנו עשויים לעדכן את האפליקציה ואת התנאים. התאריך בראש הדף יעודכן, והמשך השימוש אחרי עדכון מהווה הסכמה לתנאים המעודכנים.

דין וסמכות שיפוט

על תנאים אלה חל הדין הישראלי, וסמכות השיפוט הבלעדית נתונה לבתי המשפט המוסמכים בישראל.

General

The Near u app (the "App") is operated by Boaz Golan Management and Productions Ltd, company no. 516772696 ("we", "us"). By using the App you agree to these terms and to our Privacy Policy. If you do not agree, do not use the App.

Sign-up and age

• You must be 18 or older to use the App.
• You sign up with a phone number you use and a one-time SMS code. You must give accurate details and keep your device and account secure.
• You can view the map as a guest without signing up. Sending messages, calling and adding friends require an account.

Location

The App is location based and cannot be used without location access. Users near you will see you on the map, including your location and distance, unless you turn on invisible mode or hide from them. Share your location only if you are comfortable doing so.

Prohibited conduct

You may not use the App to:

• harass, threaten, defame, stalk or harm anyone;
• send sexually explicit, violent, racist, hateful or illegal content;
• impersonate anyone or provide false details;
• send spam, advertising or scams;
• share content you have no right to share, or images of people without their consent;
• interfere with the App, bypass its limits or collect data about users by automated means.

You can hide from any user, who then cannot see you or message you. To report a user or content, contact us at nearu@nearu.co.il.

Your content

Content you upload (profile, photos, messages, voice messages and videos) remains yours. You give us a limited permission to store, process (for example convert formats) and deliver it, only to operate the App. You are responsible for the content you send.

Demo users

To show how the App works, it may display sample profiles around you marked "Demo". They are not real people and reply to messages automatically. You can turn them off in settings ("Demo users").

Safety

We do not verify users' identity or background. Be careful when meeting people you met through the App: meet in a public place, tell a friend where you are going, and do not share sensitive information. You are responsible for your meetings and interactions with other users.

Suspension and account closure

We may limit, suspend or delete an account that breaks these terms. You can delete your account at any time in the App (Profile, then "Delete account").

Availability and liability

The App is provided "as is". We do not promise it will always work, be error free or uninterrupted, or that locations and distances will be accurate. To the extent permitted by law, we are not liable for indirect or consequential damage, or for damage caused by other users' conduct.

Changes

We may update the App and these terms. The date at the top will change, and continuing to use the App after an update means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Israel, and the competent courts in Israel have exclusive jurisdiction.
